Facebook Terms and Conditions

  1. The Premier Holidays Facebook Competition (Promotion) is organised and managed by Piggott Family Trust t/a Premier Holidays (ABN 61 975 725 667) (Premier Holidays) of 146 Mulgrave Road, Cairns, Queensland 4870.
  1. Information on how to enter and the prize forms part of these terms and conditions.
  1. Entry to the Promotion is open only to Australian residents aged eighteen (18) years or over.
  1. The following categories of individuals are ineligible to enter the Promotion:
  • Employees of Piggott Family Trust t/a Premier Holidays (ABN 61 975 725 667);
  • Immediate family of employees of Premier Holidays;
  • Employees of agencies and suppliers associated with this Promotion;
  • Immediate family of employees of agencies and suppliers associated with this promotion;
  1. The Promotion commences at 5:00 am AEST on 1st October 2012 and finishes at 5:00 pm AEST on 31 March 2013 (Promotion Period).

  1. By entering the luxury weekend giveaway, promotion Entrants acknowledge that they have read and understand and agree to be bound by these terms and conditions.
  1. The draw will be conducted at the office of Premier Holidays located at 146 Mulgrave Road, Cairns Qld 4870.
  1. The decision for eligibility of the luxury weekend giveaway will be final and no correspondence will be entered into.
  1. If there is a dispute as to the winners eligibility, Premier Holidays reserves the right, in its sole discretion, to determine the elibility of the winner.
  1. The weekend giveaway value is expressed in Australian dollars. The winner should be aware that tax implications may arise as a result of claiming the prize and should seek independent financial advice prior to claiming the prize.
  1. No responsibility is accepted for any unused or unclaimed giveaway weekend. The luxury weekend giveaway must be used or completed before the 31st May 2013. Any unused weekends will be deemed void after the expiry date and will not be honoured by the merchant or Premier Holidays. The expired weekend giveaway's are non-refundable in whole or in part. NO cash settlement or extensions will be granted for expired weekends.
  1. Except for any liability that cannot be excluded by law, Premier Holidays (including its officers, employees or agents) excludes all liability (however arising) for any claim, loss or damage arising in any way out of the Promotion.
  1. The winner of the weekend getaway package acknowledges, agrees and understand that Premier Holidays reserves the right to amend, vary and/or replace these terms and conditions of this promotion at any time, and from time to time, at Premier Holidays sole discretion.
  1. The accomodation for each weekend giveaway will be supplied soley by Premier Property Solutions Pty Ltd. Premier Property Solutions Pty Ltd is a Real Estate Property Management office of 146 Mulgrave Road, Cairns Qld 4870.
  1. Palm Cove Holiday Accomodation: The winner will receive a weekend for two adults, aged 18 years and over, at a luxury resort accomodation, managed by Premier Property Solutions Pty Ltd (the merchant) and will have a choice of accomodation at either the Sea Temple Spa & Resort Palm Cove or Peppers Beach Club Resort Palm Cove. Properties NOT managed by Premier Property Solutions (the merchant) will not be acceptable as part of this promotions giveaway. No further correspondence or requests for alternative accomodation will be accepted.
  1. The weekend giveaway recipient may advise their preferred resort location and preferred dates however this will be subject to availability by the merchant. The merchant will endeavour to secure the accomodation for the winners preferred hotel and dates, however if the accomodation is unavailable for any reason, the merchant will offer alternative dates. Premier Holidays or the merchant, cannot guarantee the accomodation will be available to you at your preferred date or time.
  1. The weekend giveaway MUST be utilised during a low holiday season period. No accomodation requests for bookings will be granted during public holidays and high holiday season periods. No correspondence or requests will be accepted.

  1. The weekend giveaway is subject to the merchant's standard terms and conditions and policies. The merchant will use its reasonable endeavours to advise you on the website of the accomodation terms and conditions that may impact on your ability to use or enjoy the product in accordance with the promotion giveaway. The merchants standard terms and conditions can be viewed at any time at
  1. Premier Holidays is not responsible if the merchants standard terms and conditions and policies affect your use or enjoyment of the product of your participation in the giveaway terms.
  1. The apartments managed by the merchant are privately owned and independently managed. The rooms are presented in a high standard & during your stay, the merchant expects them to be maintained to this standard. All rubbish is to be placed in the bins provided or in the outside bins. All dishes to be loaded into the dishwasher and the dishwasher is to be turned on before your departure.
  1. Room Type: The merchant agrees to provide a hotel suite accomodation room only. The facilities provided as part of the winners accomodation package include 1 x king size bed, bed linen, air conditioning, television, tea and coffee making facilities, ensuite shower and toilet facilities, bath towels, pool towels and a starter pack only of amenities including soap, bath gel and body mosituriser. Any additional amenities or consumables required by the guest will NOT be provided by the merchant and it is recommended that the guest review their own personal grooming requirements as necessary.
  1. Each room is provided with tea and coffee making facilities. If the guest requires additional food or drink items, the guest agrees to provide their own supplies as required. Premier Holidays or the merchant DO NOT provide any additional food, drink, or Alchol items for consumption. To avoid an unpleasant experience occurring, all food, drink or alcohol supplies is to be paid for at the time of purchase by the recipient. Any costs incurred in connection with the use of the weekend are your responsibility. Such additional costs may include, but are not limited to, the costs of meals and beverages, room service, telephone calls, internet access, laundry services, spending money, transport and transfers, insurance. Premier Holidays or the merchant DOES NOT ACCEPT LIABILITY for any food, drink or alchol expenses incurred by the guest.
  1. Your apartment is cleaned prior to arrival and upon departure. Should any additional cleaning be necessary throughout your stay, or the accommodation has had smoking inside, then additional charges at our standard cleaning rate of $40.00 AU per hour to restore the property to standard.
  1. Breakages/Damages: Any breakages or damages not caused by normal wear and tear will be incur charges, however, it is not the merchants intention to charge for replacement of accidental broken glass or plates for example. Charges will be imposed if the accommodation is left in an unreasonable condition, eg:
  • Dirty dishes not rinsed and stacked in the dishwasher
  • Rubbish not removed from the accommodation and disposed of in the outside bins
  • Soiled or stained bed covers, rugs, upholstery etc.
  • Lost, damaged or misplaced keys
    Any breakages or damage to the accommodation, its fittings or facilities will be charged to the Guest at replacement/repair cost plus 10%.
  1. Lost Keys: Room keys are the responsibility of the Guest. If these keys are lost, replacement cost of $44.00 AU per key will be charged to the Guest.
  1. Loss of Property: Please note that this apartment is a privately owned and operated home and as such the owner, Premier Holidays or merchant accepts NO responsibility for loss of property. Whilst all assistance will be taken to assist with the recovery of lost property, the responsibility remains with the Guest. It is recommended that you review your travel insurance requirements prior to commencement of your stay to ensure adequate protection of your valuables.

Premier Holidays bears no responsibility for and shall not be liable for any loss if you are unable or unwilling to use any element of the product including by reason of a Merchant's refusal to supply a product or any element of a product, or by reason of your refusal or unwillingness to take advantage of any deal terms or to use a product including because of ill health, age, incapacity, disability, behaviour or for safety reasons.
  1. Subject to the Promotion terms, the weekend giveaway may only be used to secure accomodation from the relevant merchant in full on a single transaction basis only, and may not be used incrementally. If a weekend giveaway is used at less than its face value, there shall be no entitlement to a credit nor to a new weekend or any other product, equal to the difference between the face value and the amount used.
  1. The weekend giveaway are not redeemable for cash. If for any reason, you do not or cannot use or redeemed, you will not be entitled to any consideration, credit or full or partial refund.
  1. The weekend giveaway may not, without the prior written consent of the Premier Holidays, be sold, resold or offered for sale or resale, duplicated, used, traded or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. However, with the prior approval of Premier Holidays, the weekend giveaway may be transferred without cash or non-cash consideration or any form of payment to a friend or family member or given as a gift.
  1. The weekend recipient will at all times indemnify, and keep indemnified, Premier Holidays and its directs, officers, employees, agents and related bodies corporate from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by Premier Holidays arising from any claim, demand, suit, action or proceeding by any person against you or Premier Holidays where such loss or liability arouse out of, in connection with or in respect of your conduct or your breach of any Promotion terms or condition as specified in these terms and conditions or a merchant's standard terms and conditions and policies
  1. Premier Holidays will collect personal information about the entrants for the purposes of conducting the Promotion and awarding the weekend giveaway. Eligibility is conditional on providing this information. Premier Holidays may use that information in accordance with its Privacy Policy. A copy of the Premier Holidays Privacy Policy may be obtained by visiting and following the relevant links. A request to access, update or correct any information should be specifically directed to Premier Holidays at 146 Mulgrave Road, Cairns Qld 4870 or by logging onto the Premier Holidays website at
  1. By entering the Promotion the Entrants consent to Premier Holidays using their personal information for marketing and promotional purposes. Premier Holidays may require the winner to participate in any media exposure, including but not limited to promotional, marketing and publicity activities, without any further reference or payment or other compensation.
  1. If, after entering the Promotion, the Entrant wishes Premier Holidays to cease using their personal information for marketing and promotional purposes, the entrant should contact Premier Holidays using the details listed in clause 15. By entering the Promotion, the entrant also consents to their details being stored on the Premier Holidays customer database and to receive regular updates via E News mailouts and email marketing campaigns both print and online.
  1. If the Promotion is not capable of running as planned due to any reason beyond the reasonable control of Premier Holidays (including, but not limited to fraud, a state of emergency, natural disaster, war, technical failures or any other causes) Premier Holidays reserves the right without liability to the Entrants to cancel, modify, terminate or suspend the Promotion.
  1. The agreement created under these terms and conditions is subject to the laws of the Queensland and entrants and Premier Holidays submit to the non-exclusive jurisdiction of the courts of that State.
  1. If a provision of these terms and conditions is invalid, illegal or unenforceable, then to the extent of the invalidity, illegality or unenforceability, that provision must be ignored in the interpretation of these terms and conditions. All other provisions of these terms and conditions remain in full force and effect.
  1. These terms and conditions constitute the entire agreement between the Entrant and Premier Holidays in relation to the subject matter.
